Terms of Use

These Terms of Use ("Terms") govern your access to and use of the NextGen AI Digital SAT Prep mobile application ("the App"), developed and operated by DevApps AI, a trade name of ASEL ENTERPRISES Corp ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

The App is intended for students preparing for the SAT examination, typically 14 years of age and older. By using the App, you represent that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

2. Description of Services

NextGen AI SAT Prep provides SAT preparation tools including:

• Adaptive practice sessions for Math and Reading & Writing
• Full-length and condensed practice test simulations
• AI-powered tutoring and college counseling chat features
• Flashcards with spaced repetition review
• Question scanning via device camera
• Progress tracking, score predictions, and weekly performance reports
• Personalized study plans and mistake notebooks

The App is available with both free and premium tiers, as described in Section 3 below.

3. Free Tier and Premium Subscriptions

a) Free Tier

The App provides limited free access, which includes:

• One free practice session per subject (Math and Reading & Writing) per day
• Limited daily AI Tutor and AI Counselor interactions
• Access to basic progress tracking features

Free tier limits reset daily at midnight (device local time).

b) Premium Subscriptions

Premium access unlocks all App features without daily limits. We offer the following auto-renewable subscription plans:

• Monthly Subscription: $12.99 per month
• Annual Subscription: $79.99 per year

Both plans include a 7-day free trial for new subscribers.

c) Free Trial

The 7-day free trial provides full access to all premium features at no charge. If you do not cancel your subscription before the trial period ends, your subscription will automatically convert to a paid subscription at the applicable rate. You will not be charged during the trial period if you cancel at least 24 hours before the trial expires.

d) Billing and Renewal

All payments are processed through your Apple ID account via Apple's in-app purchase system. Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time by going to your device's Settings > Apple ID > Subscriptions.

e) Refunds

Because subscriptions are processed by Apple, all refund requests must be directed to Apple. You can request a refund through reportaproblem.apple.com. We do not have the ability to issue refunds directly.

f) Restore Purchases

If you reinstall the App or switch devices, you can restore your active subscription using the "Restore Purchases" option in the App's Settings.

4. AI-Powered Features

The App uses artificial intelligence services provided by Google (Gemini) and Anthropic (Claude) to power the AI Tutor, AI College Counselor, question generation, and Scan features. You acknowledge and agree that:

• AI-generated content is provided for educational guidance and should not be considered professional academic, college admissions, or test preparation advice.
• AI responses may occasionally contain inaccuracies. You should verify important information independently.
• The content of your messages and scanned images is transmitted to third-party AI providers for processing, as described in our Privacy Policy.
• You agree not to submit content that is illegal, harmful, threatening, abusive, or otherwise objectionable through the AI features.

5. Content and Educational Disclaimer

The App provides SAT preparation materials and tools for educational purposes only. We do not guarantee:

• Any specific SAT score or score improvement
• Admission to any college or university
• That practice content will match actual SAT exam questions
• The accuracy of score predictions or college match recommendations

NextGen AI SAT Prep is an independent product and is not affiliated with, endorsed by, or associated with the College Board, the organization that administers the SAT. "SAT" is a registered trademark of the College Board.

6. User Conduct

You agree to use the App only for its intended educational purpose and in accordance with these Terms. You agree not to:

• Share, resell, or redistribute your subscription access to others
• Reverse engineer, decompile, or disassemble the App
• Attempt to extract, scrape, or systematically collect questions, content, or data from the App
• Use the App or its AI features for any unlawful or prohibited purpose
• Interfere with or disrupt the App's functionality or the servers and networks connected to it

7. Intellectual Property

All content, features, functionality, design, text, graphics, logos, and software within the App are owned by ASEL ENTERPRISES Corp (operating as DevApps AI) and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial educational purposes only.

You may not reproduce, distribute, modify, create derivative works of, or publicly display any content from the App without our prior written permission.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or free of viruses or other harmful components
• Results obtained from the App will be accurate or reliable
• Defects will be corrected in a timely manner
• AI-powered features will always be available (they depend on third-party services)

10. Limitation of Liability

To the maximum extent permitted by applicable law, ASEL ENTERPRISES Corp (operating as DevApps AI) and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ASEL ENTERPRISES Corp (operating as DevApps AI) and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice, if we believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. Cancellation of a subscription does not entitle you to a refund for any previously paid subscription period.

13. Third-Party Services

The App relies on third-party services including Apple's App Store, Google's Gemini AI, and Anthropic's Claude AI. These services are governed by their own terms and policies. We are not responsible for the availability, accuracy, or conduct of any third-party services.

14. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page and publish the revised Terms at this URL. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

If we make material changes that significantly affect your rights, we will provide notice within the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the App shall be resolved in the courts of the State of Florida.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ASEL ENTERPRISES Corp (operating as DevApps AI) regarding your use of the App and supersede any prior agreements.
